The present terms of use are intended to define the conditions of use of the website www.vr-bnb.com.
They apply to all users of the www.vr-bnb.com website, whether they have created a personal space or not.
Navigation on the website www.vr-bnb.com. Means full acceptance by the user of these terms of use, without restriction or reservation.
It is expressly agreed that:
- these terms of use prevail over any other provisions or agreements
- any provisions contrary to those contained in these Terms of Use shall be deemed to be unwritten
- if one of the clauses of these conditions of use were to be declared invalid or ineffective, the validity of the other clauses will not be affected
- the company IMMERSION will be free to modify these terms of use at will, with the responsibility for each user to consult the latest version of the said terms at each reservation

Exceptionally, the user is informed that the site may be suspended temporarily for maintenance, technical operations or reasons of interruption of service not attributable to the company IMMERSION.
Within the operational context of the website www.vr-bnb.com, the company IMMERSION may be led to use cookies as well as hypertext links.
The user is informed that his refusal to accept cookies is likely to prevent him from accessing certain features of the website and that he will not be able to make any complaint in this respect.

If he/she wishes to place an order via www.vr-bnb.com, the user must create a personal space using login data (username and password).
These data are personal and confidential.

The account of the user may be suspended if theft of his login data or use by an unauthorized third party is witnessed.
The user is informed that a declaration to the French “Commission Nationale Informatique et Liberté” has been made by the company IMMERSION.
By the application of law n° 78-17 of January 6, 1978, the user has a right of access and rectification on his personal data and/or the right to delete his personal space. It can enforce this right by sending an e-mail to the following address: contact@vr-bnb.com.
The deletion of the personal space and/or the personal data of the user will take place within a maximum delay of 15 days following the reception of the deletion request.
However, it is expressly foreseen that certain personal data may be retained by the company IMMERSION for defense purposes in the event of a complaint or subsequent litigation.
The user is informed that it will not be able hold the company IMMERSION accountable in the following cases:
- defective operation of the user's infrastructure (hardware, software, operating system ...)
- malfunctions likely to intervene at the level of resources of the user's network (slowing of the bandwidth, congestion of the Internet network ...)
- interruption of services related to maintenance operations or technical incidents
- security of the systems (e.g.: virus ...)
- loss of data
- impersonation of the user and/or fraudulent use of his/her personal space
As a general rule, the user is solely responsible for the consequences resulting from the violation of these conditions of use.
The user's account may be suspended without prior notice if a non-conforming use of the www.vr-bnb.com website, the services offered via this site, or all or part of its contents are found.
Any reproduction/modification/transmission/exploitation of all or part of the www.vr-bnb.com website or its contents is strictly prohibited.

In the absence of an amicable resolution of the dispute, the competent court will be that of the place of the registered office of the company IMMERSION.
The purpose of this article is to define the conditions of service of the vr-bnb platform accessible via the website www.vr-bnb.com.
They apply to any user who has created a personal space on the website www.vr-bnb.com.
They complement the general conditions of use of the site which are applicable to any person browsing the website www.vr-bnb.com.
The creation of a personal space implies full and complete acceptance by the user of the present general conditions of service, without any restriction or reservation, and carry recognition of prior validation of the general conditions of use.
It is expressly agreed that:
- these conditions of service shall prevail over any other provisions or agreements
- any provisions contrary to those contained in the present conditions of service will be considered as unwritten
- if one of the clauses of these conditions of service were to be declared invalid or ineffective, the validity of the other clauses will not be affected
- the company IMMERSION will be free to modify the present conditions of service at any time without particular notification, with the responsibility for each user to consult the latest version of the said conditions at each reservation
It is expressly agreed that the listings posted on the website www.vr-bnb.com are intended exclusively for professionals.
The fact that a natural or legal person makes a reservation via the vr-bnb platform materializes his commitment to the use of the booked collaborative space exclusively in a professional setting, for his own needs and without concession to one or more third parties, even gratis.
The vr-bnb platform accessible via the website www.vr-bnb.com aims to connect professionals who own collaborative spaces with professionals wishing to rent one of these spaces for half a day or a ful day.
The listings posted on the vr-bnb platform can be consulted freely by any user.
On the other hand, to book a space or publish a listing online, the creation of a personal space is necessary.
The modalities of creation and use of the personal space are defined in the general conditions of use of the website that the users acknowledge having previously consulted and validated.
Once the personal space is created, it is possible to put a listing online or to book a room.
The owner of the room to which a reservation request is addressed has a period of 5 days to accept it.
Beyond having done so within this period, the reservation request lapses.
The acceptance of a booking request results in the conclusion of a temporary provisioning contract between the two users who will be connected via the platform.
It should be noted that IMMERSION does not have the status of party to this contract.
It is neither owner nor operator of the spaces presented on the website www.vr-bnb.com.
Nor is it a broker, a real estate agent or an insurer.
Its role is strictly limited to the providing of a community platform via the site www.vr-bnb.com in order to facilitate the linking of professional owners of collaborative spaces with professionals wishing to rent one of these spaces.
In general, anyone who wishes to post a listing online or book a space via the www.vr-bnb.com website is committed to comply with these terms of service as well as the general conditions of use and have them any person under his control and/or under his direction comply with them.
It also undertakes not to contract with other users of the platform outside the www.vr-bnb.com website.
Finally, it undertakes to respect the following specific obligations:
Anyone wishing to place a listing online is committed to provide complete, accurate and precise information about the space offered for rental (e.g.: location, surface, features, internet access, additional services, access times...).
If photographs of the space and/or rented equipment are added to the listing, they must comply with copyrights.
IMMERSION has the right to withdraw a listing without notice if it deems it non-compliant.
Any person who leases a space commits itself to supply a space conforming to the listing.
The company IMMMERSION denies liability with regard to the content of listings and the conformity thereof with the spaces actually rented.
Any person who wishes to book a space via the www.vr-bnb.com website commits to use it (and the material contained therein) solely for professional purposes and for its own purposes without being able to concede it to one or more third parties, even without charge.
It also commits to verify the adequacy of the space chosen with its needs, ensure its compatibility with its own equipment and ensures the required ability of its staff to use it.
Finally, it commits to restore the meeting room to the state in which it was found upon arrival.
Generally speaking, the use of the room must be done in compliance with the laws and rules of procedure applicable.
Anyone who wishes to place a listing on the website www.vr-bnb.com is committed to subscribe to the appropriate insurance and has verified and approved the insurance subscribed by the user.
Anyone wishing to book a space via the www.vr-bnb.com website is committed to subscribe to appropriate insurance.
The company IMMERSION denies liability in the event of disorder or loss in the execution of the contract of temporary provision made between the parties.
The amount of the rental is freely determined by the person who posted the listing.
It is for him/her to determine for itself whether the transaction is subjected to VAT (and if so, to specify the amount) according to its applicable tax system and its country of attachment.
The company IMMERSION has no control over the prices charged and cannot be held responsible for the VAT charged.
Anyone wishing to make a booking request authorizes the company IMMERSION to collect his/her bank details at the time of his/her booking request, being specified that the payment amount will only be withdrawn upon validation of the final reservation by the owner of the space.
The owner of the room authorizes IMMERSION to receive funds for his account and to pay back the sum due to him within 7 days following the end of the rental, in the absence of a complaint (See Article 7).
In consideration for the use of the vr-bnb platform accessible from the website www.vr-bnb.com, a service charge will be levied by the company IMMERSION up to 30% on the transaction's amount incl. VAT, to which the Parties expressly consent.
Since payments can be made in different currencies, users of the www.vr-bnb.com website are informed of the possible fluctuation of the total cost of making it available for currency conversion purposes in addition to any related banking fees.
It is up to them to inquire directly with their banking institution in order to have any useful information on this topic.
The cancellation policy of vr-bnb is the following:
Each party has the possibility to cancel via www.vr-bnb.com the contract of temporary availability that was concluded at the time of the acceptance of the booking request.
The owner of the space may cancel the leasing contract up to 48 hours before the start of the date set for making it available.
The person booking the space may cancel the contract for the provision at any time for the following costs:
- Cancellation made more than 7 days prior to booked day: full refund
- Cancellation made between the 7th day and the 5th day prior to booked day: 70%
- Cancellation made between the 5th day and the 3rd day prior to booked day: 50%
- Cancellation made between the 3rd day and the 2nd day prior to booked day: 30%
- Cancellation made less than 2 days prior to booked day: refund of 15%
The refund will be made within 30 days after the cancellation.
The parties are free to carry out an inventory of the space at the moment of entry and exit.
Under no circumstances will they be able to keep IMMERSION responsible for the condition of the rented premises.
In the event of damage, the owner of the room will have 48 hours to submit a complaint to IMMERSION at contact@vr-bnb.com.
The company IMMERSION will forward this complaint to the user of the premises.
The parties will have to resolve the dispute directly between themselves without the company IMMERSION having to intervene.
Until the dispute is resolved, IMMERSION will keep the funds in its hands.
It will release the funds only with the agreement of the parties or by a judicial decision that has become final.
No warranty is granted for:
- the functioning of the spaces’s infrastructure (hardware, software, operating system)
- malfunctions likely to occur at the level of the resources of the network of the lessor
- the safety of the lessor’s company's systems (hardware, software)
- files of the tenant (content, modification, loss, confidentiality of data ...)
- problems reading certain files (incompatible format, corrupted files ...)
- the consequences of acts done in breach of these conditions of service
However, the parties may agree among themselves that the user will come to test the equipment in the room before the date of the booking in order to verify its compatibility with its own hardware and/or files.
Otherwise, he will not be entitled to complain about a lack of conformity or a malfunction that would occur when the room is available.
If it appears that the equipment is not adapted to its needs, it may cancel its order in accordance with the conditions laid down in Article 6.
The website www.vr-bnb.com is protected by intellectual property law.
Acceptance of the present conditions of service does not imply the transfer of these rights, the www.vr-bnb.com website and its contents remain the exclusive property of IMMERSION.
Consequently, any user is prohibited from reproducing, transferring, bringing, transferring, marketing, developing, correcting, modifying or adapting all or part of the www.vr-bnb.com website and its contents (e.g.: graphic charter, its photographs, its logos, its models, its trademarks and image in general... this is a non-exhaustive list).
